DUI stands for driving under the influence. Under Nevada law, a driver may face criminal charges for this offense when:
  • Driving under the influence of alcohol;
  • Driving with a blood alcohol concentration of .08% or greater;
  • Driving under the influence of a controlled substance;
  • Driving under the combined influence of alcohol and a controlled substance; or
  • Driving while his or her physical abilities or ability to drive safely are impaired due to the use of any organic solvent, chemical, poison or any other compound.

A person may face also face DUI charges if he or she if found to have a blood alcohol or breath alcohol concentration of .08% or greater within 2 hours of operating a motor vehicle.

When a law enforcement officer observes behavior by a driver which is indicative of drunk driving, he or she will likely pull the motorist over. Swerving, driving too slowly and speeding are all reasons that an initial police stop may be made in a Las Vegas or Henderson DUI case. After pulling the motorist over, the officer may perform field sobriety tests to determine whether his or her mental and physical abilities are impaired due to alcohol or drug use. Should the motorist fail field sobriety tests, the officer will likely make an arrest and request a blood test or breath test.
