There are numerous criminal penalties associated with a DUI conviction in Nevada. Specific penalties that a defendant may face will vary depending upon the jurisdiction, as well as a number of other important factors, including:
- The defendant’s blood alcohol concentration
- Whether the defendant caused an auto accident that resulted in injury or death
- Whether the defendant has any prior DUI convictions on his or her record
- Whether a minor under 16 was in the vehicle

Some of the general penalties one may face in the wake of a DUI conviction include: imprisonment, heavy fines, court fees, mandatory DUI School, probation, and community service. Even a first time offender may face imprisonment for 2 days up to 6 months in jail. A defense attorney can seek rehabilitation and treatment in lieu of imprisonment, but this will be addressed on a case-by-case basis by the court. The court may award alternative sentencing if the offender: pays for the treatment, is diagnosed as an alcoholic or abuser of drugs, and serves 1 day in jail or performs 24 hours of community service.
